Terms of Service

1. Acceptance of Terms

By accessing or using MailFabric (the "Service"), operated by TruSpec Virtual Solutions, LLC, you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

MailFabric is a transactional email infrastructure platform that provides APIs, dashboards, and tools for sending, monitoring, and managing application-generated emails. The Service is built on Amazon Web Services (AWS) Simple Email Service (SES) and provides additional features including template management, analytics, webhook delivery, and team collaboration.

3. Account Registration

To use MailFabric, you must create an account by providing accurate and complete information. You are responsible for maintaining the security of your account credentials, including API keys, and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use MailFabric to:

  • Send unsolicited bulk email (spam) or marketing emails without proper consent
  • Send emails that violate CAN-SPAM, GDPR, CCPA, or other applicable regulations
  • Transmit malware, phishing attempts, or other malicious content
  • Impersonate another person or entity
  • Harvest or collect email addresses without consent
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to send emails on behalf of third parties without their authorization
  • Violate any applicable local, state, national, or international law

We reserve the right to suspend or terminate accounts that violate these acceptable use policies. Repeated violations may result in permanent account termination.

5. API Usage and Rate Limits

Your use of the MailFabric API is subject to rate limits and quotas based on your subscription plan. Trial accounts are subject to sending pauses when quotas are reached. Paid plans allow overage billing as described in your plan details. We reserve the right to throttle or suspend API access if usage patterns indicate abuse or threaten the stability of the Service.

6. Email Sending and Deliverability

MailFabric processes emails through AWS SES and makes commercially reasonable efforts to deliver emails. However, we do not guarantee delivery of any specific email, as delivery depends on factors outside our control including recipient server policies, content filtering, and sender reputation. You are responsible for maintaining good sending practices and managing your domain reputation.

7. Data Handling and Retention

Email content is processed for delivery and retained according to your plan's retention period. API logs, event data, and analytics are retained as specified in your plan. You may export your data at any time through the dashboard or API. For details on how we collect and process personal data, please see our Privacy Policy.

8. Privacy

Your use of MailFabric is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Subscription and Billing

Paid plans are billed monthly or annually as selected during subscription. Overages are billed at the end of each billing cycle at your plan's overage rate. You may upgrade or downgrade your plan at any time, with changes prorated accordingly. Cancellation takes effect at the end of the current billing period. Refunds are not provided for partial billing periods.

10. Intellectual Property

MailFabric and its original content, features, and functionality are owned by TruSpec Virtual Solutions, LLC and are protected by international copyright, trademark, and other intellectual property laws. You retain all rights to the content you send through the Service. By using our API, you grant us a limited license to process your content solely for the purpose of providing the Service.

11. Service Level and Availability

We strive for high availability but do not guarantee uninterrupted access to the Service. Scale and Enterprise plans include Service Level Agreements (SLAs) with specific uptime commitments. We will provide reasonable notice of scheduled maintenance. Emergency maintenance may be performed without advance notice to protect the integrity of the Service.

12. Limitation of Liability

To the maximum extent permitted by law, TruSpec Virtual Solutions, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless TruSpec Virtual Solutions, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service dashboard at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
